R. 181 - The Parental Consent Act of 2005, strongly opposing any government attempt to mandate universal mental health screenings for children.

Congressman James Sensenbrenner, Chairman of the House Judiciary Committee, has weighed in on the importance of maintaining parental consent rights. These parental rights are now in jeopardy if H. R. 181, The Parental Consent Act of 2005 dies in committee.

Congressman Sensenbrenner has emphatically stated, "It is not, and should not be, the role of government to subject children to arbitrary mental health screenings without the consent of their parents. Parents, children, and their private doctors should determine whether a child has mental health problems, not government bureaucrats."

His statement comes just after House Majority Leader Tom DeLay stood up for parental rights and released this statement last week. “In the wake of the creation of psychiatric labels, every parent should be wary of relinquishing their responsibility to the government to define and assess their child's mental health status."

The highly controversial issue of mandatory mental health screening programs of American school children initiated by the President’s New Freedom Commission on Mental Health is the subject of widespread debate. This debate arises due to the use of subjective, unscientific psychological testing methods used for screening children for mental illness without the provision of full parental informed consent in place. This “testing” is currently awaiting federal funds to expand the implementation of screening programs nationwide.

R. 181 is passed it will prevent wasteful and potentially devastating federal funding while safeguarding the informed consent rights of all parents in what is a most serious matter, their children’s health and safety,” says Patricia Weathers President and co-founder of Ablechild. org a national non-profit group of parents committed to ensuring that the issue of informed consent and an individual’s right to “opt out” of psychological testing is a national priority.

In light of such growing controversial fervor and obvious lack of agreement on the issue of psychiatric diagnoses within the medical establishment itself, any promotion or implementation of mandated, which is equivalent to forced, screening methods should be viewed as a national threat to public health, and should be challenged by the American public.

As U. S. consumers shoulder more of the cost of their health care, they demand more information about costs and quality of care, according to nearly two-thirds of U. S. consumers (64 percent) responding to a nationwide survey. Nearly 85 percent said they believe that hospitals and physicians should be required to disclose the cost of medical services to the public. And more than half said that knowing what hospitals and doctors charge for specific treatments and exactly what insurers pay would influence where they seek care.

Among those respondents who currently have a high deductible health plan, sometimes referred to as an HDHP, which features lower premiums but higher out-of-pocket expenses, six out of 10 strongly agree that their families have become more conscious of health care costs and almost a quarter (22 percent) say they compare doctors and hospitals to find the best value for their money.

"Welcome to health care consumerism, where competitive market forces and a demand for transparency may ultimately determine the future landscape of health care," said Paula Fryland, executive vice president and manager of the national health care group within The PNC Financial Services Group, Inc (NYSE: PNC). "The number of uninsured in the U. S. continues to climb as do premiums for those who retain health care coverage. No one is willing to put a price tag on good health. While people may be willing to pay, they become more selective about procedures and providers, shopping around for the best bargain or the right combination of price and quality that their wallets can bear."

The survey of 1,000 U. Consumers More Aware of Medical Billing and Administration
As health care consumers, Americans are paying closer attention to their health care bills, especially Americans with a high deductible health plan. Yet one-third of respondents have trouble understanding the explanation of their health care insurance benefits, and nearly one-quarter report problems getting answers from their insurance company about the status of a medical claim.

Additional survey findings include:
One-third (33 percent) of consumers surveyed said that in the past year, they have had to contact their health plan at least once to resolve a claim, while one-quarter (26 percent) said they had to call two to three times. Fifteen percent of consumers said they pay their medical bills even if the bill has an error. Six in 10 consumers (60 percent) did not know that there is a limit on the time they can dispute a claim denial.

"Despite their interest in more transparency, many consumers struggle to understand the details of their medical bills and the payment process," said Fryland.

Empowering consumers to control costs and quality
High deductible health plans are changing the landscape of health care insurance. More than half of consumers (55 percent) were aware of high deductible health plans. However, only 19 percent said they would be highly likely to enroll in one if it were offered. The name itself could be the biggest barrier for new subscribers. Still, 56 percent of those currently enrolled in high deductible health plans indicated they would re-enroll in the plan again.

Six in 10 (62 percent) also believed that patients in such a plan would go to the doctor less often, while in fact, those enrolled in a high deductible health plan are split with one-third 'strongly agreeing' that they go to a doctor or hospital less often and one-third "strongly disagreeing."

"Consumers are also demanding more electronic methods of record keeping such as electronic medical records, known as EMRs, which are electronic versions of patients' medical charts that can be accessed online by all health care providers involved with a patient," said Fryland.

Only half (51 percent) of consumers were previously aware of EMRs. However, once defined, six in 10 respondents (61 percent) said that patients would receive better quality care if individuals had an EMR because all care givers would have access to the same patient history and treatment information through a digitized medical record; a majority of hospital executives (79 percent) and insurance executives (70 percent) agreed.

The most important benefit of an electronic medical record, according to consumers, is its portability: nearly eight in 10 consumers agreed or strongly agreed that EMRs allowed for coordinated care even if a patient were treated away from home. More than half of the consumers (57 percent) believed EMRs would result in fewer errors by doctors.

Survey Methodology
The PNC Health Study was conducted by the independent Boston, Massachusetts-based research firm of Chadwick Martin Bailey. The study was based on telephone interviews conducted with 150 executives from U. S. hospitals or health systems, 50 executives from insurance organizations and an online survey of 1,000 U. S. consumers. The survey was completed in February 2007. Analysis

Ok, so it was another good week for the Indian market. We are up nearly 13% in nearly 2 months with no real reasoning or catalyst which can justify this move up. Not that we do NOT like the indices to keep moving up. But something that goes up too fast too soon is always a matter of concern. If we do NOT have correction that is fine. But at least there MUST be some sideways consolidation for a healthy run up. Neither of which happened until now. Many might believe that a good Monsoon season would be a triggering factor and it may help the indices move up. But we believe that all the good news is already priced in. Moreover, taking a look from Fundamental point of view, Valuations are bit too stretched at this point. Hence, going forward, putting all of these into perspective, we believe that markets will have to rest a little before any run up, if there is one.

In the chart below, the black lines are the major support and resistance levels, other than the regular support and resistance prices. If we break either one, then the ride would be drastic.

Outlook

As was suggested in our previous week's analysis, we still suggest NOT opening any new trades at this point. Because of the above analysis. We are at the brink of a major "breakout", since there is no resistance above the last known resistance right now. But again, the huge(13%) run up itself speaks for the bullish-ness that has been around. We would keep a close eye on what happens and if we break the 7000 barrier, we would definitely go long, as we may be in for a big ride above it. To assist with breakouts this weeks article too focuses on this topic.

US Market

Markets finally gave a more clearer indication of where they are headed to, at least in the shorter term. We had a Minor Bullish breakout in Dow last week.

Extremely Overbought.

Analysis

Markets have been in a consolidation phase for a little while now. Everyday they test a high and a low and close very near the open with a positive bias. Dow in particular. Finally towards the end of last week, DOW broke past the minor resistance/overhead(orange line from the chart below) which it has been testing for a little while now. This is very bullish and we expect to see good run up, at least re-testing it's recent highs.

Now, this is an excellent example of "Mixed signals". Markets are reacting to a bad news in a good way. Look at it this way, at the end of the month you get your Credit card bill that says $2000. And looking at the bill, you jump up in joy and go out shopping for a 60" HDTV costing another $2000. Really hard to explain. This is the very reason, it gets difficult to explain the current US markets. If you are long, Hang in there and keep a close watch on how the market reacts in the following days/weeks.

Portland State University Researchers Find Smokeless Tobacco Products with up to 700% More Flavor Additives than Candy

Portland State University professor Jim Pankow’s research into flavorants in smokeless tobacco has been published in the journal of Food and Chemical Toxicology. The article, “Levels of mint and wintergreen flavorants: Smokeless tobacco products vs. confectionary products,” concludes that the level of flavorants in brand name smokeless tobacco products are up to 700 percent higher than in some well-known candy products.

Portland State University (http://www. pdx. edu) professor Jim Pankow’s research into flavorants in smokeless tobacco has been published in the journal of Food and Chemical Toxicology. The article, “Levels of mint and wintergreen flavorants: Smokeless tobacco products vs. confectionary products,” concludes that the level of flavorants in brand name smokeless tobacco products are up to 700 percent higher than in some well-known candy products.

The paper discusses measurements of methyl salicylate (wintergreen) and menthol flavorants in a large number of smokeless tobacco products. “The bottom line for our paper is that the flavorant levels in the smokeless products are in general markedly higher than in popular wintergreen and menthol flavored tobacco products,” said Pankow. “Moreover, the amount of wintergreen flavorant could by itself pose serious health risks to some consumers.”

Chemicals such as methyl salicylate are often used as flavorants by smokeless tobacco and candy manufacturers. Pankow’s study notes that for a typical user of smokeless tobacco, the levels of wintergreen flavorant in numerous brands of smokeless tobacco lead to chemical consumption rates that exceed the maximum acceptable daily intake established by the United Nations Food and Agriculture Association (FAO) and the World Health Organization (WHO).

Pankow began researching flavorants because of concern expressed within the public health community that adding flavorant compounds to smokeless tobacco products makes them more "candy like" and thus more appealing to youth. “I decided,” said Pankow, “that someone should make some direct comparisons between the levels of such flavorant compounds in major smokeless tobacco products and popular brand-name candy products."

“At a committee hearing in the 1990s, I asked the CEOs of the major tobacco companies if they believed nicotine was addictive,” said U. S. Senator Ron Wyden (Oregon). “Before Congress and the American people they denied the addictiveness of their product. This report indicates that the tobacco companies are still up to their old tricks of deceiving the public by using smokeless tobacco flavorants to appeal to underage users. Pankow’s study is an important addition to the scientific oversight of the tobacco industry and will be incredibly helpful in safeguarding the health of Americans.”

Pankow is a professor at Portland State University and a Fellow to the Center for Sustainable Processes and Practices. He has a joint appointment in the Department of Civil and Environmental Engineering in the Maseeh College of Engineering and Computer Science and the Department of Chemistry in the College of Liberal Arts and Sciences. He has earned honors for his extraordinary contributions to the field of environmental chemistry and his internationally regarded work in the behavior of air pollutants and aerosol particles in the earth's atmosphere. In 2009, he was elected to the prestigious U. S. National Academy of Engineering. His ground-breaking work, which is used in climate change research, also resulted in his receipt of the 1999 American Chemical Society Award for Creative Advances in Environmental Science and Technology, and the 2005 Haagen-Smit Prize.
