Two NFL Players buy Froots Smoothie Franchise in South Florida

A Denver Bronco and a Minnesota Viking are teaming up to tackle South Florida's fruit smoothie business. O. J. Santiago, a tight end with the National Football League's Broncos, and Henri Crockett, a linebacker with the Vikings, recently acquired franchise rights to develop the first two Froots juice bars in South Florida. Stores in Davie, near Nova Southeastern University, and Cooper City, at the intersection of Stirling Road and University Drive, are slated to open by yearÂ’s end.

Hollywood-based Froots is on tap to expand both locally and nationally with its spin on healthy treats. "The concept itself is exciting and fits perfectly into South Florida," said Santiago, an equal partner with Crockett. "Not to knock them, but I do believe we have an edge over (industry leaders) Smoothie King and Jamba Juice because of our different spin."

Smoothie drinks made with fresh fruit have been the main – and often the lone – offering of juice bars since the segment's California inception in the early 1990s. But in addition to a full complement of smoothies, Froots will offer salads and wraps, menu items not found at many competitors’ establishments. "Our wraps and salads are just as good, in terms of quality and content, as our smoothie side," said Froots Franchising President Chris Cavallo. "We may be a few pennies more than the competition, but our quality is second to none."

Founded in 2001, Froots currently owns and operates four locations in the Orlando area. The company began franchising this year because "we thought with the two models we have, kiosks and inline stores, the concept had huge potential," Cavallo said.

Future plans call for 100 stores throughout Florida and innumerable more across the country, he said. Froots expects to announce an out-of-state franchise contract within 90 days, Cavallo said. Based on the juice bar segment's current rise, Froots executives believe they will encounter an open field in its quest for a touchdown.

"The juice and smoothie bar segment has developed an average of 8 to 10 percent annually over the past three years, with $1.5 billion in annual sales," said Dan Titus, president of Juice Gallery Multimedia, a Chino Hills, Calif.-based industry publishing and consulting firm. "The market was saturated in the late 1990s, but there has been a revived interest recently."

Positioning smoothies as meal replacements, supplements or desserts are the key to success for juice bars, he said. "My strategy is to hook them on smoothies and sell them on everything else," Titus said.

O. J. Santiago's cousin, Ron Santiago, who will operate the Davie and Cooper City units, said the tropical ambiance at Froots, along with the offerings, will be a winning play. "The one thing you notice when you walk into a Froots store is the island feel, a relaxed atmosphere that is inviting to guests," he said.

Even Miami Dolphins players might be invited to partake.

Banking and financial services and property feel the pinch.

UK businesses appear to be riding out the credit crunch, and the impact of a tougher borrowing environment has made little impression on corporate failures, according to industry figures released today by Experian®, the global information services company. But, while the majority of industry sectors have escaped with a fall in business failures over the final quarter of 2007, Banking and Financial Services and Property are feeling the pinch.

The number of businesses failing in 2007 declined by 8.9 per cent, or 1,793 fewer failures, compared to 2006. With 4,674 firms going bust, a decline of 20 per cent on the same quarter in 2006, Q4 2007 saw the lowest number of failures recorded since Q3 2006.

Sector analysis
Over the year, there was an increase in business failures in just nine of the 34 sectors Experian monitors, including Building and Construction (up 2.5 per cent); Post and Telecommunications (up 18.9 per cent); Agriculture (up 26.8 per cent); Banking and Financial Services (up 9.8 per cent) and Property (up 9.7 per cent).

Not surprisingly, given the adverse weather last summer affecting crops, outbreaks of foot-and-mouth and bluetongue disease and administrative problems with EU subsidy payments, Agriculture suffered the largest increase in failures with over 25 per cent more businesses (a total of 71) going under in 2007 compared to 2006.

Business Services remains the sector with the highest number of failures, but even these fell by 20.6 per cent in Q4 (to 1,001) and by 8 per cent over the year as a whole (to 3,922).

Commentators have suggested that credit tightening would impact most on fast growing parts of the financial sector and property buyers dependent on cheap credit, and Experian’s figures bear this out. In addition to an increase in failures over the year, both Banking and Financial Services and Property saw an increase in the number of business failures in the final quarter of 2007. Over 130 businesses in the Banking and Financial Services sector failed over the year, an increase of 9.8 per cent, while Q4 2007 saw 42 companies fail, an increase of almost 20 per cent on the same quarter in 2006.

Property saw an 18.7 per cent increase in failures compared to the same quarter 2006 and a 9.7 per cent increase over the year compared to 2006, with 543 failures.

Tony Pullen, Managing Director for Experian’s Business Information division, said: “Given the widespread debate and speculation on the likely negative impact of the credit crunch on businesses, these figures are somewhat surprising. In fact, the credit crunch, more stringent lending terms, higher borrowing costs and general concern about the economy could be encouraging more vigilance and increased caution amongst business managers and owners with regards to cash flow, risk exposure and the customers they choose to deal with.

“Certainly, businesses are increasingly aware of the insight they can gain by accessing powerful business information, such as Risk Reports and Ledger360, in order to gain a picture of the financial health of their customer base, credit check customers, reduce their exposure to bad debt and ensure they are getting the best returns on marketing investment.”

Regional trends
Business failures increased in just two regions in 2007. Northern Ireland experienced a 25.4 per cent increase, while Wales experienced a 3 per cent increase. These two regions, along with the East Midlands, also experienced an increase in business failures over the final quarter of 2007 compared to Q4 2006.

London (including the City of London) experienced the biggest fall in business failures in 2007 compared to 2006 with 1,391 fewer firms failing, a 30.4 per cent drop, and also the biggest fall over the final quarter of the year compared to Q4 2006, with 937 fewer failures, a 53.3 per cent drop.

Type of failure
Analysing the type of business failure recorded over the year, the largest decline has come in administration orders, down 28.9 per cent. Other large declines came in the number of businesses seeking voluntary arrangements (down 23.0 per cent) and in those going into receivership (down 21.6 per cent). Voluntary liquidations and compulsory liquidations also decreased, but by a much lower 4.1 and 1.4 per cent respectively.

A press conference and campaign kick-off are scheduled at City Hall in Riverside on Friday, June 11 at 9:00 a. m. to announce the “Loan Modification Scam Alert” campaign, a national initiative designed to combat loan modification scams.

On Friday, June 11, a partnership of local, state and national government agencies, nonprofit organizations and financial institutions will gather at the steps of City Hall in Riverside to launch a public education campaign designed to help homeowners protect themselves against loan modification scams, find trusted help and report illegal activity to authorities. The press conference and kick-off are among several events held in recent months in cities across the country to announce the “Loan Modification Scam Alert” campaign, a national initiative designed to combat loan modification scams.

California has consistently posted one of the nation’s highest foreclosure rates. The Inland Empire is among several metropolitan areas in California to consistently rank among areas with the highest foreclosure rates.

“Too many residents in the Inland Empire, like homeowners nationwide, are losing thousands of dollars and their homes to scam artists who make big promises and then do little or nothing to help them save their homes,” said Thomas Coates, program manager for the Housing Opportunities Collaborative of the Inland Empire, a nonprofit organization comprised of a number of HUD-approved counseling agencies that do not charge consumers a fee for housing counseling. “Anyone can be a victim and the people of the Inland Empire need to know what resources are available to them. They need to know that legal aid groups, financial institutions, and HUD-certified counselors are offering free services to anyone seeking help.”

The regional kickoff event will feature representatives from the Federal Deposit Insurance Corporation, NeighborWorks® America, Riverside and San Bernardino Counties, the local faith-based community, the Better Business Bureau of the Southland, the Federal Reserve Bank of San Francisco, the Federal Trade Commission and local housing counseling agencies, including the Fair Housing Council of Riverside County, Neighborhood Housing Services of the Inland Empire, Neighborhood Partnership Housing Services and Springboard Nonprofit Consumer Credit Management. Also present will be local homeowners to share their personal experiences with loan modification scams to inform other homeowners in their community about this activity.

NeighborWorks® America will coordinate the nationwide effort through its 235 community-based affiliates and other local, state and national partner organizations, including the Federal Deposit Insurance Corporation, Department of Housing and Urban Development (HUD), the Federal Trade Commission, the U. S. Department of the Treasury, Fannie Mae, Freddie Mac and the Lawyers’ Committee for Civil Rights Under Law.

Together, the partners aim to reach thousands of distressed homeowners in hundreds of communities at high risk for fraud activity. The campaign will target all audiences, but its resources are focused sharpest on those groups that have already seen high levels of scam activity, including seniors, Hispanics, African Americans and Asian Americans.

Hands-on training will be provided to housing counselors to help them identify homeowners who have been victims of loan modification scams.

However, too often that potential goes unrealized because doctors and hospitals are often reluctant to participate.

Using mediation to resolve medical malpractice lawsuits offers many benefits, but barriers put up by doctors, hospitals, and their lawyers often stand in the way of it being employed effectively, a study co-authored by Columbia Law School Professor Carol Liebman finds.

The study found that when used, mediation could not only reduce the costs of litigation, and has the potential to offer closure to plaintiffs and ensure that procedures are changed in hospitals to prevent recurrences of the error that sparked the lawsuit. However, too often that potential goes unrealized.

“Change will require medical leaders, hospital administrators, and malpractice insurers to temper their suspicion of the tort system sufficiently to approach medical errors and adverse events as learning opportunities, and to retain lawyers who embrace mediation as an opportunity to solve problems, show compassion, and improve care,” according to the study, published in the Journal of Health, Politics, Policy and Law.

Liebman, an internationally recognized expert on mediation and negotiation, directs the Law School’s Mediation Clinic. Co-author Chris Stern Hyman was formerly an Adjunct Research Scholar at the Law School.

Mediation is where an impartial third party helps both sides in a dispute negotiate a mutually acceptable resolution. The parties are not required to settle and can return to litigation. However, all mediation sessions are confidential and what is discussed is inadmissible if the dispute goes to court.

The study looked at 31 cases from 11 nonprofit hospitals in New York City in 2006 and 2007 that went to mediation. About 70 percent of the cases settled either during or after mediation, resulting in monetary settlements from $35,000 to $1.7 million.

On the surface, the case for mediation would appear to be compelling in medical malpractice cases because:
 The outcome is under the parties’ control.  Plaintiffs can receive payment soon after the harm instead of waiting years.  Defendants do not have to pay outside lawyers to try the case.  Members of the medical staff do not have to prepare for discovery and a trial.  Even if the mediation doesn’t resolve the case, it may create enough momentum to lead to a settlement.

In spite of those benefits and the fact that many of the mediated cases settled, the study found “major challenges” remain for mediation to gain greater acceptance in malpractice suits.

Most significantly, in none of the cases studied did a doctor take part in the mediation. The study authors view that as a missed opportunity, noting “it is possible that plaintiffs would have been even more satisfied with the process had their physicians demonstrated respect and caring” by attending the mediation.

Defense lawyers often cited the doctors’ work schedules to explain their absence. Others did not want to subject the doctors to being verbally attacked by the plaintiff. This “deprives them and their patients of the opportunity for healing, understanding, forgiveness, and repair of broken relationships and failed communication,” the study concluded.

The authors cited research that found patients expect an apology after a medical error, and that most doctors want to oblige, but they—and their lawyers--refrain from doing so out of fear of legal liability. However, the confidentiality of mediation would obviate that.

“Anecdotes abound of injured patients and their family members who have continued to seek care from—and even recommended to their friends—hospitals that apologize for medical errors and adverse events,” according to the study.

The absence of doctors in mediation also limits the ability, the authors write, for doctors and hospitals to learn from the medical errors and improve the quality of care.

Liebman co-authored the study with Chris Stern Hyman of the Medical Mediation Group; Clyde B. Schechter of the Albert Einstein Medical Center; and William M. Sage of the University of Texas School of Law.

Seventeen employees from ParknPool received an early 2010 Christmas gift when they happily packed up their belongings and moved across town to a brand new $1,000,000 Green Operations Center. ParknPool, in business since 1998, sells commercial outdoor furniture and site amenities, supplying bleachers and grandstands, portable bleachers and stadium bleachers, as well as other bleacher seating such as aluminum bleachers, park furnishings, restaurant furniture and much more.

The staff at ParknPool were all able to become such close friends after spending the last five years in a 1,500 square foot office together. Now the employees are thrilled at the space and beauty of the new 5,000 square foot facility. Alice Vaughan-Williams says, “I am ecstatic about having new technology and plenty of space!”

It has been ParknPool’s mission not only to build a technologically advanced operations center, but to make that office building environmentally responsible also. In their business they provide site amenities that are “enviro-friendly,” so this office building is a natural extension of their work.

Lineage Architects of Verona, Virginia designed the sustainable building. Pennie Garber, Principal Architect of the firm says “Jim and Brenda Fonner should be commended for their courage to build a sustainable building. We as a society can talk about sustainability all we want (and we designers can plan and draw all day long), but until businesses like ParknPool take the initiative and spend the money to actually build something that is environmentally conscionable, no good is actually done. It’s my hope that many will be willing to follow in their footsteps.”

The design team worked diligently with Jim and Brenda to protect the trees on the heavily forested site, ensuring eighty percent of the existing tree cover has remained completely undisturbed. The linear footprint of the building allows maximum natural light into the interior spaces, and every occupant has a window to the exterior. Interior windows were also incorporated into the design plan, allowing natural light to travel the entire building. This natural light and ventilation will reduce energy consumption associated with artificial light and HVAC systems.

John Hennis of LexCon, LLC, ParknPool’s General Contractor used “Insulated Concrete Forms” (ICF) to construct the building’s exterior walls. These forms are comprised of expanded Polystyrene which hold “poured-in-place” concrete. When a standard concrete wall is poured the forms typically used are made of plywood, and are removed and discarded after the concrete is hardened. In the ICF construction used for ParknPool’s building the polystyrene forms were left in place. This not only eliminated waste on the jobsite, but has created an energy efficient wall. In addition to the energy efficiency, ICF construction is incredibly durable and can withstand hurricanes, tornados and other disasters that conventionally framed buildings cannot.

The building has a “cool roof,” a metal roof designated as such because it does not absorb excessive heat from the sun, resulting in lower cooling costs during the summer months. Metal roofs have longer life spans than asphalt shingle roofs, lasting for many decades. They are very low maintenance and durable. The roof on ParknPool’s building was finished with Kynar paint, which is the same finish required on airplanes. The attic was filled with “Icynene” soft spray foam insulation, which is healthier, quieter and more energy efficient than other insulations available.

The siding selected for ParknPool’s building is fiber cement, which is durable as well as resistant to rot and insects. No trees are harvested when fiber cement siding is specified. Great care was taken with all of the materials selected for this project to ensure that locally produced materials were used. Not only did this benefit local economies, but it required shorter transport, using less diesel fuel.

In May 2007, Navratilova made her Tennis Channel debut during the channel's groundbreaking French Open coverage.

Navratilova's first on-air duties will take place during the 2008 Australian Open Jan. 14-27, when she joins network anchor/producer Bill Macatee -- himself a major component of Tennis Channel's 2007 French Open activity -- as one of two primary commentators. Tennis Channel's first Australian Open telecast takes place prime time, Monday, Jan. 14, at 7 p. m. ET, the beginning of 30 hours of live or first-run match telecasts this year. The network will show a prime-time block of live matches almost every night of the two-week tournament, in addition to special replays of the men's and women's singles semifinals and finals (initially on ESPN2).
