The federal district court in Rhode Island granted, on November 4, 2010, without objection from BCBSRI, “a Preliminary Injunction against Plaintiff Blue Cross & Blue Shield of Rhode Island preventing them from withholding any further payments for services rendered by Barlow to BCBSRI subscribers to satisfy an alleged debt of Back to Health Chiropractic”, one week after the court ruled, on October 27, 2010 against BCBSRI over its recoupment practice for over $400,000 against two healthcare providers, finding that federal law ERISA preempts, supersedes and limits BCBSRI overpayment recoupment practice. The defendant’s motion for preliminary injunction was filed and granted by the court without any objections from BCBSRI, one week after the court found, on October 27, 2010, that BCBSRI’s overpayment recoupment practice based on alleged provider contract dispute and fraud claims are completely preempted by federal law ERISA, as BCBSRI’s post-payment audits with overpayment recoupment is an ERISA fiduciary conduct, and federal law limits BCBSRI’s potential recovery, in accordance with several recent US Supreme Court decisions.

On July 17, 2009, Blue Cross Blue Shield of Rhode Island commenced an overpayment lawsuit against two healthcare providers in the Superior Court of State of Rhode Island. "Blue Cross alleges that Defendants purposely miscoded services which resulted in Blue Cross paying them over $400,000 for services that were not covered by "the applicable BCBSRI subscriber contracts”. “Blue Cross stated its conclusion that the miscoding was an "intentional misrepresentation” and demanded repayment of $412,952.93”. BCBSRI, among other things, also alleged: “Count I alleges that Defendants breached their Provider Agreements, by submitting claims for unauthorized services, and, in the case of Defendant Korsen, by terminating the Provider Agreement without proper notice to Blue Cross. Count II is for fraud based on false and fraudulent claims submitted by Defendants for compensation”. “Defendants removed the case to this Court arguing that Blue Cross' state law claims for breach of contract and fraud (Counts I and II) are completely preempted by the Employee Retirement Income Security Act ("ERISA")”.

On October 27, 2010, Federal court made following ruling in denying BCBSRI’s motion to remand the case to the State Court.

In deciding that the overpayment recoupment dispute with fraud claims is not governed by BCBSRI provider contract under state law, but is completely governed and preempted by federal law ERISA, the court explained:

“The Court holds further that there is no independent legal duty controlling Defendants' conduct herein; because, while the Provider Agreements do impose duties on Defendants, these duties are not independent of the terms of the ERISA plans. Consequently, the Court holds that Blue Cross' Count I for breach of contract, alleging that Defendants breached the Provider Agreements by submitting claims using improper CPT codes and submitting claims for services that were inappropriate or not medically necessary, and Count II for fraud are completely preempted by ERISA. The Court converts these claims to a federal ERISA § 502 (a) (3) claim.”

In deciding that federal law ERISA prohibits or limits BCBSRI’s overpayment recovery or "withholding" from healthcare providers, by citing the recent U. S. Supreme Court Rulings, the court explained:

“Though the Court's ruling limits Blue Cross' potential recovery, this holding is consistent with the legislative aims identified by the Supreme Court in Davila: "The limited remedies available under ERISA are an inherent part of the 'careful balancing' between ensuring fair and prompt enforcement of rights under a plan and the encouragement of the creation of such plans." 542 U. S. at 215 (quoting Pilot Life Ins. Co. v. Dedeaux, 481 U. S. 41, 55 (1987). Moreover, the Congressional objectives of consistency in regulation and uniform administration of ERISA plans are met”.

The Natural Solutions Foundation's Medical Director, Rima E. Laibow, MD, announced that Congressional support is building to compel the U. S. to follow its own laws in adopting policy and directing delegates to the CODEX ALIMENTARIUS Commission meeting in Rome next month. Although the U. S. has announced its intention to support the restrictive Vitamin and Mineral Guidelines, members of Congress urged the U. S. to oppose or postpone the adoption of the CODEX Vitamin and Mineral Guideline (VMG) since the US is legally forbidden from harmonizing with any international law which violates U. S. law. The VMG violation of the 1994 Dietary Supplements Health Education Act (DSHEA). Under DSHEA, limits cannot be set on for nutrients which are treated as foods, not drugs.

Representatives Ron Paul (R, TX), Dan Burton (R, IN) and Peter DiFazio (D, OR) sent a joint Congressional Letter to the U. S. CODEX Manager, Dr. Ed Scarbrough, demanding that he direct US Delegates to the 28th CODEX ALIMENTARIUS Commission in Rome next month to oppose ratification of the restrictive VMG. Their bipartisan letter noted that "the VMGÂ… threatens our rights and laws in serious ways. This standard represents a violation of the significant protection offered to us in this country by laws like DSHEA and similar statutes."

CODEX Office on June 1, 2005, and urge "the policy of the United States in general, and your office and the CODEX Delegation in particular to adopt policies and positions which are strictly in line with U. S. law preventing harmonization with any international standard or guideline which is in conflict with, or contradiction of, United States lawÂ…."

The Dietary Supplement Health and Education Act - DSHEA - categorizes nutrients as foods as such, they have no upper limits - and recognizes that individual health status, age, toxic load, genetics, etc., will lead to varying nutrient needs throughout the life span and between groups. By guaranteeing unrestricted access to a wide variety of high potency nutrients, DSHEA, in effect, secured for Americans the right to use nutrients and supplements to prevent, treat and cure chronic degenerative diseases, prevent premature aging, and enhance their immune functions.

The VMS would ban high potency nutrients since any nutritional density higher than that found in food would be illegal with or without a prescription. Developing countries are urged to adopt CODEX standards as national law although countries with marginally nourished populations who adopt this restrictive standard will face widespread death and malnutrition.

Because CODEX erroneously considers nutrients to be dangerous toxins, it has elected to determine permissible levels using the wrong science - Toxicology. Toxicology is designed to protect people from dangerous compounds. Toxicology uses "Risk Assessment" to determine the highest dose of a substance which can be given while producing no discernable impact on a person. After dividing that dose by 100, and subtracting an arbitrary contribution of that nutrient by a mythical "average expectable global daily diet," a final value which has no nutritional benefit is obtained. Risk Assessment does not, by its very nature, consider benefits since toxins have none. These ultra low, ineffective values comprise the Maximum Permissible Upper Limit (MPULs) of permitted nutrients. All others will be forbidden as will higher dosages of permitted nutrients. The proper science to apply to Dietary Supplements is the science of Nutrition. Federal Courts have held that "DSHEA indicates that Congress generally intended to harmonize the treatment of dietary supplements with that of foods when it added the dietary supplement subsection..." (U. S. District Court Judge Tena Campbell in Nutraceutical Corporatio, et al. v. Lester Crawford, Acting Commissioner).

In 1997, the US passed Title 19, USC 3512 which specifically forbids harmonization by the U. S. with any standard which violates U. S. law. Because of this law, any attempt to support the VMS is a violation of U. S. law. The FDA specifically states that its policy is to accept international standards, even if not completed, in preference to domestic standards and to use every means to bring U. S. regulations and standards into conformity with those international standards. This, and U. S. CODEX policy, is illegal under current U. S. law.

These SCA crews (with a total of 1,272 high school age members) restored 329,392 feet of trail at 185 project sites in city and county parks. An additional 57,641 feet of new trail was created by these kids. Over 16 million people have the potential of benefiting from these improvements to their urban green spaces and ultimately to their quality of life. First established more than three decades ago, SCA’s urban community-based programs have experienced significant growth recently. In 2006, SCA fielded 326 high school students in 6 communities; this number has grown to approximately 1,400 participants in urban areas nationwide this year.

Partnership Award: Southern Off-Road Bicycle Association and Tennessee Valley Authority

Partnership Award: This award is given to a partnership that has benefited agencies or services within the field of trail planning, design, or implementation and has contributed toward a positive public exposure for these fields.
Hikers and mountain bikers can enjoy the outdoors on Raccoon Mountain as a result of a continued partnership between the Tennessee Valley Authority and the Southern Off-Road Bicycle Association. The current trail system encircles TVA’s Raccoon Mountain Reservoir with over 17 miles of single track trail and includes trails for both novice and expert users. It has become a destination trail system, with people traveling from all over to ride it. Multiple mountain biking and trail running events occur on weekends during the spring, summer, and fall months such as the Southeast Regional Championships and the Scenic City Trail Marathon. Both parties worked together to help maintain the integrity of the land by providing a trail that is environmentally friendly and teaching users the Leave No Trace philosophy of trail recreation.

Community Service Award: Coal River Group

In 2004, the Coal River was listed as one of the ten most endangered rivers in the country. Because of the river’s listing the Coal River Group was formed. The Group’s goals include preserving and protecting the Big Coal, Little Coal, and Coal rivers, preserving and interpreting the history of the rivers, and creating recreational and economic opportunities for the watershed. To help people gain access to the rivers, the group created the 88 mile Walhonde Water Trail. Almost every weekend during the summer the Group sponsors and leads a float trip over short sections of the trail. The annual “Tour de Coal” floats down the lower eleven miles. This leisurely trip began with 44 canoes, kayaks and other boats the first year. In 2009, over 165 boats and 200 people took part.

Trails for Public Service: This award is given to an individual that has demonstrated significant and consistent support of trail planning, design, or implementation through strong leadership and/or legislative efforts.

Senator Robert H. Plymale represents the 5th District from West Virginia in the U. S. Senate. As an advocate for trails throughout southern West Virginia, the Senator has been a key player in the development of public trails for recreation and alternative means of transportation, including the Huntington Museum of Art Multi-Sensory Trail and the Paul Ambrose Trail for Health. Recognizing the economic development and community revitalization potential that the Hatfield McCoy Trails would bring to coal-dependent counties in southern West Virginia, he has been active in mapping, planning, and promoting hundreds of miles of motorized, private trail systems. Since 2005, off-highway vehicle recreation has become southern West Virginia’s most frequently utilized outdoor recreation attraction, surpassed only by white water rafting. The popularity of the Hatfield McCoy Trails system can be attributed the Senator’s enthusiasm for outdoor recreation and his ability to see the economic benefits trails can have for a community.

Outstanding Media Award: Bob Fulcher
Outstanding Media Award: This award is given to an organization or individual that has demonstrated significant and sustained efforts to provide positive public exposure and education in the field of trail use, planning, design, or implementation.

Bob Fulcher, Park Manager of the Cumberland Trail State Park has worked as a park naturalist and ranger for over 25 years. For more than 10 years, people from all over the world have been tuning in each Sunday night, to listen to The Cumberland Trail -- a half-hour radio program hosted by Bob. The Cumberland Trail is the only state or national park in America using weekly musical documentaries to present and preserve its heritage. The radio program has served as an invaluable tool to keep the regional community up to date on volunteer work projects along the Cumberland Trail State Park. For great and rare old-time, bluegrass, gospel, rockabilly, vintage country, western swing, blues, and folk from the 1920s on, tune in to The Cumberland Trail.

Trails and the Arts Award: Slavic Village Development and Cleveland Public Art and Parkworks

Trails and the Arts Award: This award recognizes outstanding public art projects, interpretive signs, or other creative structures associated with trail related improvements.

The Slavic Village neighborhood of Cleveland, Ohio, boasts the first urban rail-trail conversion in the city, the Morgana Run Trail. As part of the public art program for the Morgana Run Trail, Slavic Village Development and Cleveland Public Art and ParkWorks collaborated to develop a distinguishing marker for the East 49th Street trailhead. The groups wanted a marker that would be an inspiring piece of artwork while also serving to identify the entrance to the trail. They found their answer with local artist Jake Beckman who designed the 35 foot tall flower sculpture that now admits thousands of people each year to the trail. The flower sculpture is comprised of a steel “stem” topped by bicycle wheel “petals” which are illuminated at night with efficient LED lights, providing the trail with a unique and eye catching entrance.

Trails for Health Award: Step Into Cuba Alliance

Trails for Health Award: This award recognizes a community’s commitment to improving access to trails and promoting their use and importance for increasing physical activity with a commitment to long term change through trails use.

Based in the village of Cuba, New Mexico, Step into Cuba is a program combined of 18 local and national groups working to promote healthy physical activity through development of sidewalks, paths, trails, social support, and opportunities for lifestyle change. The Alliance’s vision is to create a “greener,” healthier, and more pedestrian friendly community by improving pedestrian trails and connecting these to surrounding scenic Federal lands, including a new segment of the Continental Divide Trail. Regularly scheduled public meetings are held to gather input and ideas from community members. Workshops have been organized to discuss the ideas and develop long-term strategy to maximize the improvements being made. A walkability plan has been developed utilizing pedestrian safety consultants and a park plan has been developed in conjunction with the University of New Mexico. Step Into Cuba Alliance is committed to the health of its citizens and believes trails and pedestrian pathways are the answer to life-long fitness.

State-of-the-Art Technology Award: City of San Jose, Department of Park, Recreation & Neighborhood Services

State-of-the-Art Technology Award: This award recognizes a trails-related product, process, or service that has significantly met a need, addressed an issue, or increased efficiency in trail design, development, or maintenance.

Persons seeking assistance from emergency personnel often encounter a lack of useful location information along trails and the City of San Jose has set out to change this. San José’s mileage markers convey precise location data to the trail user in an easy to understand manner. Supporting data for each marker is available to emergency services personnel and provides a complete set of location, surface, and accessibility data to help emergency services provide speedy assistance. San José’s Trail Network provides opportunities for recreation and commuting and is enjoyed by thousands of residents each day. By 2022, as part of its Green Vision, the City will have 35 interconnected trail systems across 100 miles. A growing population using trails is likely to require more emergency services and these services can now be deployed in a rapid and efficient manner.

Outstanding Trail Sharing Award: Ride With Respect

Outstanding Trail Sharing Award: This award recognizes innovative and successful trail sharing efforts, programs, and systems.

Ride With Respect aims to protect natural resources while accommodating diverse recreation on public land through motorized and non-motorized use. They reach this goal through trail restoration projects and educational programs that offer certified rider-training classes. One of these projects is the Sovereign Trail in Moab, Utah. The "Sovereign Trail" is the only single track trail system in the immediate Moab area that is open to motorcycles and it is an area that is a great example of different trail enthusiast groups working together toward a common goal. Though the area is on Utah State lands, most of the management and maintenance of the area falls on the shoulders of Ride with Respect. The organization exemplifies what can happen when all user types put aside their differences and concentrate on the common ground of their love for the land and recreational trails.

Planning/Design Award: Tennessee Riverpark

Planning/Design Award: This award honors problem-solving through innovative methods on a trail project. This project includes successful aspects of public participation and/or public agency involvement, and has been planned to enhance the recreational trails opportunities within the project area.

The Tennessee Riverpark is a 13 mile linear park and trail system that runs along the Tennessee River through the heart of downtown Chattanooga. Its development was a turning point for Chattanooga, revitalizing downtown and making trails more accessible to the local community. The most comprehensive and inclusive planning process ever undertaken in Chattanooga began in 1985 with an appointed task force. Their goal was to orchestrate a true, all-inclusive community planning process. After hundreds of public and private meetings involving thousands of citizens, the Tennessee Riverpark Master Plan was established. The vision operated under the premise that the Chattanooga riverfront was owned by everyone and should be developed “under a guiding idea which will bring its banks to life, make it a central point of pride for the City’s people, and move it to the forefront of national consciousness.” By reconnecting with the river, the city overhauled its image and fueled the engine of central economic development. Its impact has been so immense that the Riverfront Renaissance Story is being told internationally.

Corporate Award: Lyndhurst Foundation

Best Trails State Award: State of Minnesota

Best Trails State Award: This award recognizes a state that is facilitating an outstanding statewide system of trails.

In 2008, Minnesota passed the Clean Water, Land, and Legacy Act. As a result, 14.25% of funds generate by the new tax will provide funding for regional parks, state parks, and trails. Over the next year, $35 million dollars will go towards enhancing trails in parks and the construction of new trails. Minnesota was one of the first states to establish a rails-to-trails system starting in the late 1960’s. In addition to rail-trails, today the State Trails system includes 1,266 off-road trail miles. The state has over 22,000 miles of snowmobile trails, more than 2,300 miles of Off Highway Vehicle trails, 1000 miles of equestrian trails, and over 4,400 miles of water trails. The Minnesota Department of Natural Resources works with private land owners, organizations, cities, and local communities in order to help provide the population with accessible and fun recreational activities through trail use.

Lifetime Service Award: Kurt Loheit

Lifetime Service Award: This award recognizes an individual demonstrating long-standing, significant, and exemplary service to trail planning, implementation, and recreation.

Kurt Loheit has more than 20 years of experience as a passionate outdoorsman, who has been instrumental in organizing and leading trail programs with the Palos Verdes Peninsula Land Conservancy and numerous other organizations across the nation, including the California Trails and Greenways Conference, founding the Los Angeles Chapter of Concerned Off Road Bicyclists Association, and being the Resources Director of the International Mountain Bicyclist Association. Kurt has been a leader of the hiking and mountain bike community’s efforts to contribute to the design, construction, and maintenance of sustainable trail systems. He has supervised trail projects and trail building schools around the country, he’s written about trail building issues in a number of mountain biking and land management publications, and he’s presented many times at national, state, and local trails conferences. In 2004 he was inducted into the Mountain Bike Hall of Fame.

Hulet Hornbeck Award: Carroll Vogel

Hulet Hornbeck Award: This award is for an individual that, like Hulet Hornbeck, exemplifies long-standing vision and wisdom in support of trails.

In 1990, after more than a decade of building and repairing trails and bridges in the backcountry for the National Park Service and the Student Conservation Association, Carroll started a private business, “Sahale LLC,” that eventually would become the dominant national designer and builder of recreational cable bridges. During Carroll’s early measured efforts on suspension bridges owned by the US Forest Service, he focused on building and rebuilding existing ones more efficiently. After reconstructing older bridges in need of repair and learning design techniques, he began to make his own creative adjustments. His own alterations led to reduced costs and the efficient use of materials to make longer spans not only more durable, but more economical. Of the more than 200 trail bridges he built, Carroll showed us that we are still looking for the boundaries in bridge design. We are still finding new structures, applications, and uses of materials.

Results from 156 Hospitals Validate VISICU's eICU® Program as Solution for U. S. Critical Care Crisis

ICU patients are nearly one-third less likely to die, on average, when treated at hospitals using the eICU® care delivery model, according to results released today by VISICU, Inc. (http://visicu. mediaroom. com/)

Data from more than 185,000 patients treated in 2006-2007 at hospital intensive care units (ICUs) using VISICU's eICU technology show significant reductions in mortality rates. Both published data from individual hospitals, and an analysis of VISICU data collected from 156 hospitals nationwide, show that using advanced eICU technologies to link remote critical care specialists 24/7 with hospital ICU teams is a potential solution to the nation's growing crisis in critical care.

Severity-adjusted hospital mortality rates over the two-year period were 9.6 percent for 185,464 patients at 156 hospitals with the eICU Program, compared to the national hospital mortality rate of 13.5 percent. The 29 percent reduction in hospital mortality translates to 7,233 lives saved in this sample alone, and provides evidence that hospitals using the VISICU eICU Program model are achieving improved patient outcomes.

The eICU Program (http://www. eicu. net/) uses advanced technology to connect ICU patients and their bedside care teams with remote centralized eICU Centers staffed by intensivists and nurses. The Leapfrog Group (http://www. leapfroggroup. org/about_us/leapfrog-factsheet) documented numerous studies that show intensivist staffing reduces the risk of ICU mortality by up to 40 percent, but less than a third of patients nationwide have access to these specialists.

"24/7 intensivist-led care has become a necessity, not a luxury, and this program is the only identified way to address the growing critical care crisis resulting from aging baby boomers and the shortage of critical care doctors and nurses," said Dr. Brian Rosenfeld, VISICU chief medical officer (http://www. visicu. com/company/clinicalbios. html). "The numbers are compelling -- when all hospitals nationwide begin to effectively integrate remote intensivist support with technology in their critical care models, more than 100,000 additional lives will be saved each year. Approximately 200 hospitals and 40 health systems nationwide currently serve more than 300,000 ICU patients each year through eICU Centers located across 28 states. Using advanced eICU software and hardware, one intensivist physician and two critical care nurses can support up to 120 ICU beds at a time.

Sutter Health
Sutter Health (http://www. sutterhealth. org/about/patientsafety/ps_eicu. html), a 27-hospital system based in Sacramento, Calif., opened its first eICU Center in 2003 and a second in 2004. The two centers monitor more than 400 ICU beds at 24 hospitals across a wide geographic area in Northern California.

"Sutter Health's eICU Centers have assisted our ICU partners in reducing mortality through early identification and early treatment for specific diseases, such as sepsis," said Teresa Rincon, R. N., nurse director for the Sutter Health Sierra Region eICU Center. "Studies suggest that sepsis kills over 500 people every day in the United States alone. Anyone who has an infection can develop this disease. Our eICU team provides an extra set of eyes on patients and additional expert guidance for treatment in a place where patients' lives depend on how fast we can provide appropriate care."

UMass Memorial Health Care
UMass Memorial Health Care (http://www. umassmemorial. org/MedicalCenterIP. cfm? id=3027), consisting of UMass Memorial Medical Center in Worcester, Mass., and four community hospitals, has seen positive results from the eICU Center it established to cover its 112 ICU beds at three locations.

"To sustain the excellent care we already deliver in the ICU, hospitals nationwide are being encouraged to identify solutions to prepare for an aging population and ongoing shortage of intensivists," said UMass Memorial Health System Medical Director Craig Lilly, M. D. "It's not simply putting good providers at bedside or adding a camera, microphone and software to an ICU room; it's the combination of people and technology demonstrated by the striking success of the eICU program at UMass," he added. "We have seen reductions in mortality, length of stay and cost per case wherever we have implemented the eICU model. It's the future of critical care medicine, and it can only expand from here."

Avera Health 
Recent research by Avera Health (http://www. averamckennan. org/amck/services/eicu/EICU. aspx), a rural health system based in Sioux Falls, S. D., that operates 233 facilities in five states, found that mortality dropped 29 percent and patient length of stay decreased up to 46 percent when comparing severity-adjusted data on mortality and length of stay from one year before and two years following implementation of their eICU Program.

"We calculated an annual reduction of 4,146 ICU days and 572 hospitals days for the four facilities we studied, which translates to millions of dollars saved to our system," said Avera McKennan Chief Medical Officer David Kapaska, M. D. "This improvement can be attributed to improved workflow, antibiotic protocols, glycemic control and avoidance of a range of complications - all made possible by the daily reports and best-practice guidelines provided to our clinical staff through the eICU Program."
